Montana class action alleges State Farm systematically refuses to pay pre- and post-scans

A class action filed in Montana's First Judicial District Court in Lewis and Clark County alleges State Farm systematically refuses to pay for pre- and post-repair scans when those scans are performed at independent collision repair shops. The plaintiffs are policyholder Lana Curry and Francis Cote, Montana's former chief deputy insurance commissioner.

The complaint points to the Advisory Memorandum the Commissioner of Securities and Insurance issued in August 2024, which prohibits insurers from refusing to pay for these scans and treats paying for them only at direct repair program shops — or paying DRP shops more — as illegal steering.
